Why can’t I open an account if I work for a broker-dealer?

Fennel provides its customers with certain market data as part of its app experience. This data is used during the discovery phase, as well as at the point of order entry. The exchanges that Fennel uses to provide this data (NYSE and NASDAQ) have different rules and pricing tiers depending on whether the user of the data is a professional or non-professional subscriber. As a result, Fennel has determined that at this time it will limit its app to non-professional subscribers only. Employees of a broker dealer are considered professional subscribers.

“Nonprofessional Subscriber" refers to any person who receives market data solely for their personal, non-business use and who is also not a “Securities Professional,” meaning that the person is:

  • Not registered or qualified with the Securities and Exchange Commission, the Commodities Futures Trading Commission, any state securities agency, any securities exchange/association, or any commodities/futures contract market/association; and
  • Not engaged as an "investment advisor," as that term is defined in Section 202(a)(11) of the Investment Advisers Act of 1940 (whether or not registered or qualified under that Act); and
  • Not employed by a bank or other organization exempt from registration under Federal and/or state securities laws to perform functions that would require them to be so registered or qualified if they were to perform such functions for an organization not so exempt.
  • A person who works outside of the United States will be considered a “Securities Professional” if they perform the same functions as someone who would be considered a “Securities Professional” in the United States.

By signing up for a Fennel account, you are certifying to Fennel that you fall into the category of a non-professional subscriber. If you become a professional subscriber during any time that you are a user of the Fennel app, you certify to Fennel that you will notify the compliance department at compliance@fennel-financials.com immediately.

Please refer to Fennel's Market Data Addendum for additional information and specific policies of the exchanges.
